GALVESTON – A Texarkana man believes he purchased a defective pickup truck from a Dickinson dealership and has filed a lawsuit.
According to recent court documents filed July 12 in Galveston County District Court, Jose Anzaldua bought a 2004 Dodge Crew Cab truck for $17,745 from Michael Gillaspia, doing business as Texas Truck Sales and Gllaspia Investment Group Inc., on July 13, 2010, only to discover fuel spraying from the vehicle shortly afterwards.
The original petition alleges the defendant refused to accept the truck “of what he clearly knew was a defective vehicle and insisted that the customer attempt to use the warranty which would only become effective after 30 days.”
Anzaldua claims the vehicle’s engine broke down completely after a few more weeks of operation, adding repair estimates at the time were quoted at over $18,000 “which is more than the plaintiff originally paid.”
“The defendant misrepresented the condition of the vehicle and failed to inform the plaintiff that the vehicle had serious mechanical defects which were known to the defendant,” the suit says.
“This misrepresentation and failure to disclose information concerning the goods or services, which was known at the time of the transaction by the defendant, is false, misleading and deceptive in that it rendered the vehicle useless in the hands of the plaintiff.”
A jury trial is requested.
The plaintiff is representing himself in the case.
Galveston County 56th District Court Judge Lonnie Cox is presiding over the litigation.
